Everyone is very busy, this comes as no surprise these days. There is a lot of pressure to perform to higher and higher standards. Corporate layoffs and outsourcing are more common than in the past, which leaves those who remain in the predicament of having to do more with less time and resources. Although this at first may seem like a dim view of contemporary business, and albeit in some cases it truly may be, it is the reality of the day. However, it does force taking a hard look at processes and coming up with creative solutions to streamline workflows that possibly should have been done anyway. There are process improvements and efficiencies, but there is also a temptation to cut corners. It is a reality today that companies, to gain higher profits may, and do, use inferior products, less than desirable tactics and methods and some wander into waters that border or cross into criminal activity. There may be times where certain practices may not be illegal, but are certainly not moral or at the least certainly not desirable. For example, Nike took a lot of criticism several years ago when one of their manufacturing plants overseas was using child labor (Nisen, 2013). This is not a singular event, but only an example of what could happen, another notable example was the Enron collapse in the 1990’s where the top executives were found guilty of fraud and conspiracy (Barrionuevo, 2006).Let’s examine this scenario: You are the manager in a financial services firm, ABC Financial Services. This is a fictional company and no similarities are implied or stated to any real company. As the manager, you are well liked in the company and within the community. There is a lot of regulation around business practices within the financial services industry. You find out from a friend at your Tuesday night softball league that your direct competitor is struggling and is in risk of going out of business. The competitor has a customer base that is 3 times that of your current customer base. The friend that informs you of this has another friend that works there and is seeing if there are any vacancies at your firm. The “friend of a friend” supposedly has knowledge of the inner workings of the competing firm that would be a great benefit to you. -What are the potential benefits of speaking to the friend of a friend? -What are the potential risks of speaking to the friend of a friend? -Research and report back on any regulations you may find that allow or disallow this conversation and potential hiring of the other individual. -What are the benefits or risks, if after having a conversation with the other individual, should they decide to stay with their current company or go someone else? -Should you have a conversation with your management about this situation, or since you are the manager, you feel this is ok (think through all aspects here)? This is tempting to use emotional-based responses, but using supporting research, defend your position based on credible resources. What can you suggest on your classmates’ posts that will improve upon their research and thoughts?References:Barrionuevo, A. (2006, May 25). Enron Chiefs Guilty of Fraud and Conspiracy. New York Times.Nisen, M. (2013, May 13). How Nike Solved Its Sweatshop Problem. BusinessInsider.

SNOTE: hould employers check an applicant’s credit reports as part of the hiring process? Each year retailers lose $30 billion a year from employee theft and $55 million because of workplace violence. Those who commit fraud are often living above their means, but there is no evidence that workers with poor credit reports are more likely to steal from their employers, be violent, or quit their jobs. And refusing to hire someone with a low credit score creates a sad catch-22: People have poor credit records because they are unemployed, and because they have poor credit records they continue to be unemployed. What is the right thing for an employer to do? -This problem is from Chapter 24 of Textbook: Introduction to Business Law, 6th Edition Jeffrey F. Beatty; Susan s. Samuelson: Patricia Sanchez Abril ISBN-10:1-337-40434-1

New Jersey International Speedway, Inc., (Speedway) owned the New Jersey International Speedway, a racetrack next to Route 312 in Jersey Shore, New Jersey. In May 2005, on the weekend before the Winston Cup race, Speedway opened part of its parking facility to recreational vehicles (RVs). Speedway voluntarily positioned its employee Sammy Spacecadet at the entrance to the parking area as a security guard and to direct traffic.Gary Gearhead, who was planning to attend the race, drove an RV south on Route 312 toward Speedway. Meanwhile, Mike Motorunner, who was right behind Gearhead’s vehicle, was also driving south on Route 312 on a motorcycle, on which his wife, Michelle, was a passenger. As Gearhead approached the parking area, he saw Spacecadet signaling him to turn left into the Speedway parking area, which he began to do. At the same time, Motorunner attempted to pass the RV on its left side, and the two vehicles collided. Michelle sustained a broken right leg and hip, among other injuries, in the collision. Michelle Motorunner sued Speedway, and others, for negligence. Based on these facts, answer the following questions: -(1) What are the elements of negligence? -(2) Which element of negligence is at the center of this dispute? Explain. -(3) How is a court likely to rule in this case and why? Explain with specific reference to the facts of the case and the requirements of negligence.
